Ventura Terms of Use and End User License Agreement
These Terms of Use and End User License Agreement (the "Terms") govern your use of Ventura, including the Ventura mobile application, website, subscriptions, and related services (together, the "Service").
By creating an account, using the Service, downloading the app, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use Ventura.
Ventura is operated by Ventura App Ltd. For questions about these Terms, contact support@getventuraapp.com.
1. Eligibility and Accounts
You must be old enough to use Ventura under the laws that apply to you. You are responsible for keeping your account credentials secure and for all activity that occurs through your account.
You agree to provide accurate information, keep your account information up to date, and notify us if you believe your account has been accessed without permission.
2. License to Use the App
Subject to these Terms, Ventura grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Ventura app on devices you own or control, solely for your personal use of the Service.
You may not copy, modify, reverse engineer, sell, lease, sublicense, distribute, or create derivative works based on the app or Service, except where applicable law gives you a right that cannot be excluded.
If you downloaded Ventura through the Apple App Store, your app license is also subject to Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
3. Safe and Lawful Use
Ventura is built for car communities, routes, meets, events, marketplace listings, points of interest, and related social features. You must use Ventura safely and lawfully.
- Do not use Ventura in a way that distracts you while driving.
- Always follow road rules, speed limits, and local laws.
- Do not organize, promote, or participate in illegal or dangerous activity.
- Do not harass, threaten, abuse, impersonate, or dox other people.
- Do not upload unlawful, misleading, infringing, or harmful content.
Map, route, event, and location information may be incomplete or inaccurate. You remain responsible for your own safety, route choices, vehicle operation, and compliance with applicable laws.
4. User Content
You retain ownership of content you create or upload to Ventura, such as profile information, posts, comments, messages, routes, events, photos, videos, listings, and group content ("User Content").
You grant Ventura a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, process, transmit, and distribute your User Content as needed to operate, improve, protect, and promote the Service.
You are responsible for your User Content and must have the rights needed to upload and share it. We may remove, restrict, or moderate User Content that we believe violates these Terms, our policies, or applicable law.
Ventura has no tolerance for objectionable content or abusive users. You must not post, send, sell, upload, or encourage content or conduct that is harassing, hateful, threatening, sexually explicit, exploitative, fraudulent, unlawful, or otherwise objectionable.
Ventura may use automated and manual filtering to prevent objectionable material from being posted. Users can report or flag objectionable content, block abusive users, and contact Ventura at support@getventuraapp.com. We review objectionable content reports and aim to act within 24 hours by removing offending content and suspending, removing, or ejecting the user who provided it where appropriate.
5. Marketplace, Events, Groups, and Routes
Ventura may let users create marketplace listings, plan routes, join groups, create events, share points of interest, and interact with other users. Unless we say otherwise in writing, Ventura is not a party to transactions, meetups, sales, purchases, or arrangements between users.
You are responsible for checking listings, routes, event details, locations, users, businesses, and safety conditions before acting on information found in Ventura.
6. Subscriptions and Payments
Ventura may offer paid subscriptions, including Ventura Premium. Subscription features, prices, trial availability, and billing periods are shown in the app before purchase and may vary by country, platform, offer, and store account.
Purchases made in the iOS app are processed by Apple through your Apple ID. Purchases made on Android are processed by Google Play or the applicable payment provider. Ventura does not collect or store full payment card details.
Auto-renewable subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the current period ends. You can manage or cancel subscriptions through the App Store or Google Play subscription settings for the account used to purchase.
Subscription access continues until the end of the paid billing period after cancellation. Refunds, where available, are handled by the store or payment provider that processed the purchase.
7. Privacy
Our collection and use of personal information is described in the Ventura Privacy Policy. By using Ventura, you acknowledge that your information will be handled as described there.
8. Third-Party Services
Ventura may use or link to third-party services, including maps, authentication, analytics, payments, app stores, hosting providers, and external websites. These third-party services may have their own terms and privacy policies.
We are not responsible for third-party services, content, websites, or actions, except where applicable law says otherwise.
9. Service Changes and Availability
We may update, add, remove, suspend, or discontinue parts of the Service at any time. We work to keep Ventura available, but we do not guarantee uninterrupted, error-free, or fully secure access.
10. Termination
You may stop using Ventura at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, created risk for users or the Service, or used Ventura unlawfully.
Some provisions of these Terms will continue after termination where needed, such as provisions relating to ownership, licenses already granted, disclaimers, limits of liability, and dispute terms.
11. Disclaimers
Ventura is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.
Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law.
12. Limitation of Liability
To the maximum extent permitted by law, Ventura and its owners, directors, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.
Our total liability for claims relating to the Service will be limited to the greater of the amount you paid to Ventura for the Service in the 12 months before the claim or GBP 50, unless applicable law requires otherwise.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as updating this page, providing an in-app notice, or using another appropriate method.
Your continued use of Ventura after updated Terms become effective means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of England and Wales, except where local consumer law gives you mandatory rights in your country of residence.
